§ 1 APPLICATION TO ENTREPRENEURS AND DEFINITIONS

1. The following general terms and conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity (§ 13 BGB).

§2 CONCLUSION OF A CONTRACT, STORAGE OF THE CONTRACT TEXT

3. The presentation of the goods in our online shop does not constitute a legally binding offer of contract on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.

4. When an order is received in our online shop, the following rules apply: The consumer submits a binding contract offer by successfully going through the ordering procedure provided in our online shop.

The order takes place in the following steps:

1) Selection of the desired goods

2) Confirm by clicking the "Add to shopping cart" button

3) Checking the information in the shopping cart

4) Press the button "to checkout"

5) Registration in the internet shop after registration and entering the registration details (email address and password).

6) Another check or correction of the respective entered data.

7) Binding dispatch of the order by clicking the button "order for a fee" or "buy"

Before the binding submission of the order, the consumer can return to the website on which the customer's information is recorded and correct or correct input errors by pressing the "Back" button contained in the Internet browser used by him after checking his details Cancel the order process by closing the Internet browser. We immediately confirm receipt of the order by an automatically generated email ("order confirmation"). With this we accept your offer.

5. Storage of the contract text for orders via our internet shop: We save the contract text and send you the order data and our terms and conditions by email. You can also view the terms and conditions at any time at https://www.andastudio.co/pages/agb. You can view your past orders in our customer area under My Account -> My Orders.

§3 PRICES, SHIPPING COSTS, PAYMENT, DUE DATE

1. The prices indicated include the statutory sales tax and other price components. The prices do not include the respective shipping costs

2. The consumer has the option of paying by PayPal, credit card (Visa, Mastercard). When paying by credit card, the purchase price is reserved on your credit card at the time of ordering (“authorization”). Your credit card account will be charged at the time we send the goods to you.

3. Klarna invoice & instant transfer

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer the following payment options. Payment is made to Klarna:

Invoice: The payment period is 14 days from dispatch of the goods / the ticket / or, in the case of other services, the provision of the service. The full billing terms for the countries where this payment method is available can be found here:

Sofortüberweisung: Available in Germany and Austria. Your account will be debited immediately after you have placed your order.

The use of the invoice payment method requires a positive credit check. In this respect, we pass on your data to Klarna for the purpose of address and credit checks as part of the purchase initiation and processing of the purchase contract. Please understand that we can only offer you payment methods that are permitted based on the results of the credit check. Further information and the terms of use of Klarna, general information about Klarna can be found at https://www.klarna.com/de. Your personal data will be treated by Klarna in accordance with the applicable data protection regulations and in accordance with the information in Klarna’s data protection regulations.

(4) For the " Buy 3 Get 1 Free" campaign, customers should keep all items to fully benefit the discount. In case of partial returns, full prices of the kept products will be charged and will be deducted from the refund amount

§4 DELIVERY & RETURNS

(1) Unless we have expressly stated otherwise in the product description, all items offered by us are ready for immediate shipment. Pre-ordered items do not fall into this category and require the specified shipping time to be sent to the customer. Generally, orders are processed within 1-2 days. Due to the large number of orders, orders may take longer to process during the vacation and sales seasons. DHL deliveries usually take 2-4 days depending on location. All shipments outside of Germany have a delivery time of approximately 3-5 business days. When paying in advance, the delivery period begins on the day after the payment order to the credit institution responsible for the transfer, for all other payment methods on the day after the conclusion of the contract. If the period falls on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the next working day.  

(2) The risk of accidental loss and accidental deterioration of the sold item shall not pass to the Buyer until the item has been handed over, even in the case of a mail-order purchase.

 

(3)If customers pay a shipping cost for their order and cancel/return their order, the shipping cost will not be refunded.

 

(4)For returns from EU, we charge a fixed cost of 9.90€. Returns should be made within 14 days of receiving the order.

The return shipping cost for the UK, Switzerland and the rest of the EU is €14.90 per order. The shipping label will be provided by us.

Return from the USA : We don't provide pre paid return label for USA customers and customers are responsible from the return cost of their order and the arrival of their package back to us. 

Please note that orders outside the EU will incur VAT and import duties and the customer is responsible for these costs. In the event of a return, these costs will not be refunded.

 By submitting a return, the customer accepts that the return will be sent to the retailer within the 14-day return period. Even having a pre-paid return label, if customer faisl to return the package within 14 days, they are no longer eligible for return. Misusage of the return label and sendsing the package despite exceeding the return deadline, Anda Textilien GmbH is not responsible for the return of these packages to the customer.


(5) Free returns are available for customers in Germany under conditions. 

(6) For customer in Germany, to be eligible for free returns, customers should keep at least one item in case of returns. If customers returns the order completely, we charge a fixed return fee of 6.99 Euros.

(7) Items labeled with FINAL SALE in the product page are not eligible for refunds & exchanges.  

§5 RETENTION OF TITLE

We reserve ownership of the goods until the purchase price has been paid in full.

§6 RIGHT OF WITHDRAWAL OF THE CUSTOMER AS CONSUMER

Right of Withdrawal

Consumers are entitled to a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed:

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.

by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You can use the attached model withdrawal form for this purpose, but this is not mandatory.

Consequences of cancellation

If you withdraw from this contract, we will have given you all payments that we have received from you, excluding delivery costs to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment.

We can refuse the repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the date on which you informed us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
